Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kyurrency App ("Service"), and any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Service ("Content"). Your access to and use of the Service are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access or use the Service.

Basics

You are responsible for your use of the Service, for any Content you post to the Service, and for any consequences thereof. All Public Content (media files) you upload could be purchased and viewed by other users. You should only provide Content that you are comfortable sharing with others under these Terms.

User Restrictions, Content and Conduct

You retain your rights to any Content you submit, post or display on or through the Service. By submitting, posting or displaying Content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods (now known or later developed).

These Terms grant permission to you, to use the Service for personal use only. Under no circumstances may you:

• Access, tamper with, or use non-public areas of the Service.
  
• Probe, scan, or test the vulnerability of any system or network or breach or circumvent any security or authentication measures of the Service.
• Interfere with, or disrupt, (or attempt to do so), the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, mail-bombing the Service, or by scripting the creation of Content in such a manner as to interfere with or create an undue burden on the Service.
• Decompose, disassemble, or reverse engineer any part of the Service, or otherwise use a Service for any purpose other than those provided for by us and in conjunction with the operations of the Service.
• Take any action to cause, or exploit, known or latent malfunctions, bugs or other defects in the Service or system used to operate the Service.

You are prohibited from posting or transmitting any material to the Service that could:

• Interfere with anyone else's use of the Service.
• Be considered inappropriate, abusive, harmful, illegal, indecent, obscene or offensive.
• Threatening in any way encourage anyone to break the law, violate anyone's copyright or other property right, interfere with the privacy of any other user or contain a virus or any other harmful component.

All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such Content. Although we may monitor and review the Content, we are under no obligation to do so, and we assume no liability or responsibility arising from the contents of any user materials.

You understand that by using the Service, you may be exposed to Content that might be considered inappropriate, abusive, harmful, illegal, indecent, obscene or offensive.

We may change, edit, or remove any user Content that we deem inappropriate, abusive, harmful, illegal, indecent, obscene, offensive, or otherwise violating our policies in any way. We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity of anyone posting such Content. Also, we will also terminate a user’s account if the user is determined to be a repeat infringer.

Under no circumstances will Kyurrency be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

Copyright Policy

We reserve the right to remove copyrighted Content without prior notice, at our sole discretion due a request from the original author. In appropriate circumstances, we will also terminate a user’s account if the user is determined to be a repeat infringer.

Links and Third­Party Products and Services

The Service may contain links to third­party web sites or services that are not owned or controlled by us, and assumes no responsibility for, the content, privacy policies, or practices of any third­party web sites or services. You further acknowledge and agree that Kyurrency shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third­party web sites or services that you visit.

Purchasing Virtual Content and Subscriptions

For all charges for any Virtual Content sold on the Service, we, or payment processor acting on our behalf, will bill your credit card or alternative payment method. You agree to pay all fees and applicable taxes incurred by you or anyone using an account registered to you. In the event that your credit card or alternative payment provider refuses to pay us for an amount credited to your account, we will have the right to delete the products or deactivate the services purchased from your account. You agree that you will not cancel or reverse any charges for such Virtual Content or otherwise attempt to defraud us.

All purchases of Virtual Content are Non-Returnable and Non-Refundable.

You will not receive money or other compensation for unused Virtual Content when an account is canceled, whether such cancelation was voluntary or involuntary.

Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters and numbers) with your account. Kyurrency cannot and will not be liable for any loss or damage arising from your failure to comply with the above.

Your data is very important to us and its safety is always our priority, but although Kyurrency adopts appropriate practices about storage, periodic backups, data processing and reasonable security measures to protect your information against destruction or unauthorized access, we cannot guarantee that our security procedures will be flawless, that transmissions of your data will always be secure or that unauthorized third parties will never be able to defeat our security systems. Also, we cannot guarantee the persistence of the 100% of your data if a situation of data loss occurs. Since these scenarios are out of our control we do not offer any kind of compensation due any data loss.

Privacy

Any information that you provide to the Service is subject to our Privacy Policy, which governs our collection and use of your information. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information.

Termination

You may terminate your agreement with Kyurrency at any time for any or no reason by discontinuing your use of the Service. You do not need to specifically inform Kyurrency when you stop using the Service.

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 15 days notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of United States of America, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Disclaimer

The Service and all Content therein are provided on an "as is" basis without warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the Service or the Content contained on the App for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of the Service.

Every effort is made to keep the Service up and running smoothly. However, Kyurrency takes no responsibility for, and will not be liable for, the Service being temporarily unavailable due to technical issues beyond our control.
